1. GENERAL
These Terms & Conditions (“Terms”) apply to all quotations, sales, and supply of goods by Haus O Fire (“we”, “us”, “our”). By accepting a quote, placing an order, or purchasing products, the customer (“you”) agrees to be bound by these Terms.
Haus O Fire imports and supplies Solid Granite Hearths, Lightweight Concrete Mantles, and Prokan Argentinian Grills.

2. QUOTATIONS
All quotations are valid for 30 days from the date issued unless otherwise stated.
Prices are subject to change without notice after the validity period expires.
Quotes are based on information provided at the time. Any variations, additional requirements, or unforeseen circumstances may result in revised pricing.

3. PAYMENT TERMS
A deposit may be required to secure your order.
Full payment must be received prior to dispatch or delivery unless otherwise agreed in writing.
Late payments may incur additional fees and/or delays.

4. DELIVERY & ACCEPTANCE
Delivery dates are estimates only and may be affected by shipping delays, supplier issues, or unforeseen circumstances.
Risk transfers to the customer upon delivery to site.
All goods must be inspected upon delivery.
Claims
Any claims for damaged, defective, or missing items must be made within 72 hours of delivery.
Claims must be submitted in writing with photographic evidence.
Goods are deemed accepted if no claim is made within this timeframe.

5. PRODUCT INFORMATION – NATURAL STONE & CONCRETE
IMPORTANT – MUST BE READ PRIOR TO INSTALLATION
All natural stone and concrete products must be installed by a licensed and qualified tradesperson
(e.g., tiler, stonemason, builder).
Natural stone is a product of nature and may include variations in:
Colour
Tone
Veining
Pitting and fissures
Surface texture
Minor chips or imperfections
These characteristics are not defects and are not grounds for return or claim.
No claims will be accepted once installation has commenced.

6. GRILL INSTALLATION
IMPORTANT – MUST BE READ PRIOR TO INSTALLATION
All grill and solid fuel products must be installed in accordance with all applicable Australian Standards, local regulations, and manufacturer instructions.
All installations must comply with local building codes, fire safety regulations, and manufacturer specifications.
It is the customer’s responsibility to ensure site suitability prior to installation.
Additional Components
If additional components (e.g., flues, extensions, fittings, structural supports) are required due to site conditions such as wall cavities, roof obstructions, or compliance requirements:
These must be purchased separately.
Any additional costs are the responsibility of the customer.

7. WARRANTIES
Once installed, products are covered by the manufacturer’s warranty only, where applicable.
Haus O Fire does not provide additional warranties beyond those required by Australian Consumer Law.

Exclusions
Warranty does not cover: – Incorrect installation – Failure to follow manufacturer instructions – Misuse or improper use – Normal wear and tear – Damage caused during installation – Environmental factors (heat stress, moisture, movement, etc.)

8. LIMITATION OF LIABILITY
To the maximum extent permitted by law: – Haus O Fire is not liable for: – Installation errors – Structural or site-related issues – Indirect, incidental, or consequential loss – Loss of profits, delays, or business interruption
Our liability is limited to:
Replacement of goods, or Refund of the purchase price (at our discretion)

9. RETURNS & CANCELLATIONS
Orders cannot be cancelled once goods have been ordered or imported.
Returns are not accepted for:
Change of mind
Natural variations in stone or concrete
Any approved return may be subject to restocking fees and must be returned in original condition.

10. STORAGE & HANDLING
Customers are responsible for appropriate storage of goods after delivery.
Products must be stored in a dry, safe environment to prevent damage.
Any damage occurring after delivery is the customer’s responsibility.

11. COMPLIANCE & RESPONSIBILITY
All products must be installed and used in accordance with:
Australian Standards
Local building codes
Manufacturer guidelines
The customer and/or installer is responsible for ensuring compliance.

Haus O Fire accepts no responsibility for non-compliant installations.

12. FORCE MAJEURE
Haus O Fire is not liable for delays or failure to perform due to events beyond our control, including but not limited to: – Shipping delays – Supplier issues – Natural disasters – Industrial actions

13. AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (ACL).
Where goods are not of acceptable quality, you are entitled to remedies as provided under the ACL.

14. GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia.
Where goods are supplied nationally, the parties agree that any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, regardless of the customer’s location.

15. ACCEPTANCE
By proceeding with a quote, purchase, or installation, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
